<p>Have you heard yet about &#8220;<strong>The Cajun Navy</strong>&#8220;?</p>
<p>If not, here&#8217;s the group&#8217;s <a href="https://www.facebook.com/groups/TheCajunNavy/" target="_blank">Facebook page</a>. According to the <a href="http://www.huffingtonpost.com/entry/cajun-navy-louisiana_us_57bb1bf3e4b00d9c3a18c9d9" target="_blank">Huffington Post</a> &#8220;<strong>The Cajun Navy&#8221; is &#8220;Louisiana’s 100% Volunteer Group That’s Helping Flood Victims</strong>&#8220;:</p>
<blockquote><p>While FEMA was just gearing up, a group of people dubbed &#8216;The Cajun Navy&#8217; were already navigating the floodwaters to rescue stranded neighbors in the state. The ranks of the Cajun Navy aren’t precise, but it&#8217;s there were easily “several dozen” captains and volunteers, and cautiously put the estimate at around 100 people.</p>
<p>“All of a sudden before the feds could react, we got thousands of boats in the water, with locals helping each other,” said Kevin “Chef KD” Dietz.</p></blockquote>
<p>Glenn Reynolds wrote about the Cajun Navy in his USA Today column yesterday:</p>
<blockquote><p>A collection of boat-owning volunteers called the <a href="https://pjmedia.com/trending/2016/08/18/the-government-cant-help-you-but-the-cajun-navy-can/">”Cajun Navy”</a> has been rescuing people and transporting supplies, using Facebook to coordinate their efforts. As one said, &#8220;In South Louisiana, we don’t wait for help, we are the help.” That’s a good approach, because the history of major disasters suggests that it’s a mistake to expect help to come very soon. We’ve seen this over and over again, and not just with Katrina.</p>
<p>The truth is that it’s better to be the help than to wait for help. There’s one group of first responders that’s always on the scene at every disaster — the people who are already there. After a disaster, roads are likely to be blocked, power lines are likely to be down, and it’s likely to be days or weeks before outside help arrives in any quantity. Bad things happen. When they do, don’t wait for help. Be the help. It’s an attitude that’s not just for Cajuns.</p></blockquote>
<p><strong>MP:</strong> If you, like most people, think these plucky, brave, courageous, self-determined volunteer rescuers deserved universal praise and admiration, and agree that they should serve as a model for other communities to follow when the next disaster strikes, you&#8217;d be mostly correct. Unless you&#8217;re a politician like<a href="http://senate.la.gov/senators/senpage.asp?SenID=26" target="_blank"> Louisiana State Senator Jonathan W. <p>Note that the proposal was made by a republican not a democrat. Just like most occupational licensing is a state issue and the Rs control a whole lot of states leg and governor. Yet with the exception of AZ what license laws have been repealed. (I guess the contributions are just to good)</p>

<p>R by someone&#8217;s name doesn&#8217;t make them a small government conservative. Too many have been corrupted by the sweet deals that government employees and representatives give each other. They need to be removed, which is why, despite his faults we really need to get Trump in at a national level. there is a reason the establishment despises him, they know he won&#8217;t put up with their crap. It is like the Clinton foundation, for all of them, only to a smaller scale.</p>

<p>Regulate the Cajun Navy? A predictable but thoroughly disgusting suggestion by politicians. It made me throw up in my mouth a little.</p>
<p>Lawmaker: &#8220;Licensing for Cajun Navy is not meant to limit them, but rather empower&#8221;</p>
<p>Newsflash: they are already empowered. There is nothing lawmakers can do that will not *limit* their ability to respond quickly and efficiently to emergencies.</p>
<p>Does anyone believe these good Samaritans would be shot by law enforcement if they ignored orders to keep out of flooded areas?</p>

<p>Good point, Ron. Precisely because politicians DO care so much about power, they will never, as a group, do what their dumbest legislator wants.</p>
<p>After socialist Vermont experienced massive devastation from Hurricane Irene, virtually all regulations limiting recovery were ignored with little controversy. Every farmer with a backhoe was out doing things that would have ordinarily required more formal approvals. </p>
<p>State Senator Perry&#8217;s bad idea will die a quick and natural death if we let it.</p>

<p>the track record of many of these &#8220;bad ideas&#8221; actually making it to law is quite mixed. many of them do, in fact, become law.</p>
<p>the regulations and certifications around helping people are outlandish.</p>
<p>if you doubt this, i encourage you to try opening, say, a homeless shelter.</p>
<p>post katrina, the response in terms of regulatory burden was extremely mixed.</p>

<p>on the one hand, a lot of churches etc we able to feed and shelter people.</p>

<p>the correct response here is not to sit back and wait for bad ideas to die, but, rather, to stand up and publicize what bad ideas they are, thereby helping them die.</p>

<p>how then do we have odious regulation of hair braiding, interior design, baby clothing, and a hundred other terrible polices that hinder us?</p>
<p>is seems we are often left to the mercies of the dumbest or the most crooked. </p>
<p>i&#8217;m sure there are counter examples. in any system as complex as the US, there&#8217;s going to be evidence on both sides.</p>
<p>but the fact that there is a lot of evidence or regulators getting in the way demonstrates a real problem that counter examples do not mitigate.</p>

<p>OK. Fair enough. Let&#8217;s follow this &#8220;controversy&#8221; and see if Senator Perry&#8217;s proposals are enacted and enforced in the next flood. </p>
<p>Of course I&#8217;m not saying that no bad ideas are ever enacted into law and enforced. I&#8217;m saying the craziest ones aren&#8217;t. I&#8217;m saying that that trying to do that in this example will reduce, not increase, the political power of those pushing the idea. </p>
<p>For better, and for worse, politicians tend to take actions that will get them votes. In THIS example, I predict that doing the right thing will be popular. It&#8217;s not clear to me that you even disagree with that.</p>

<p>What got me in the BP disaster was the the EPA insistence of not using oil skimmers, because they only removed 95% of the oil, and having a 5% oil discharge in sea water is illegal under EPA rules. Not that it mattered, since the government wouldn&#8217;t relax rules to allow foreign manned ships to work in American waters. Instead, we let the oil sit there. </p>
<p>Of course that may have been the best thing. The Gulf ecosystem, surely showed us how well it could clean up the oil mess naturally without much human intervention.</p>

<p>Exactly. EPA and other agencies were in the way at almost every step &#8211; beginning with firefighters flooding the oil rig with water so it sank to the bottom destroying 4100ft. of pipe, and making it extremely difficult to shut off the oil.</p>
<p>I&#8217;m not sure the lesson taught by the Gulf ecosystem was learned by those who need it most.</p>

<p>Along the same line, just because a person has a driver&#8217;s license does not mean they are a good driver. I think it is more of a screening and indentifcation process than anything else. Who and why should people be driving on the road or be in a restricted-access area.</p>

<p>Yes. The looters are looting, while the helper is helping people. Why would you assume that police barricades are everywhere in a disaster area and why would you assume anyone crossing one is automatically a looter? Have you lost so much faith in your fellow man?</p>

<p>I assume people in command and control will have choices and that will be one of their choices from past practice. I also assume that some people such as you will have a problem with other people being in control, but I personally don&#8217;t have a problem with leaving some things to those who are trained in their field.</p>

<p>At 25, I had a lot of faith in my fellow man. Since then:</p>
<p>&#8211; My home has been burglarized twice;</p>
<p>&#8211; I&#8217;ve had a knife held at my abdomen by a stranger;</p>
<p>&#8211; my brother who sufferred from cerebral palsey has been beaten unconscious by a youth gang.</p>
<p>I could list a dozen more such events.</p>
<p>At 65, I am not nearly as naive as I was 40 years ago.</p>

<p>That is truly unfortunate things that you have experienced is true. You know what you forgot to list, though? The thousands of good things that have happened to you for every one of the dozens of other things you list. That awful things happen doesn&#8217;t negate those far more often occurring good things.</p>
<p>But it is easier to dwell on the few, the easily remembered bad things, than appreciate the far more abundant good that surrounds us. Instead of being grateful for those things, I&#8217;m sure like most who claim to not be &#8220;nearly as naive as&#8221; they were, you simply feel entitled to them.</p>

<p>2. Wouldn&#8217;t the Cajun Navy be pretty effective at finding any looters and delivering some &#8220;street justice&#8221;&#8230;. well I guess it would &#8220;water justice&#8221; or &#8220;flood justice&#8221;&#8230;.</p>

<p>Looters in New Orleans diring the Katrina disaster stole televisions and computers. </p>
<p>Although many homes in Louisiana were flooded this month, not all of their possessions were destroyed. Many two story homes were flooded to a level of four feet.</p>

<p>I&#8217;m just looking at it from an operational standpoint. Obviously, if I am the first person to the scene of an accident/disaster, I render whatever aid I can. Once the police/EMTs and etc. arrive they are in control of who does what, when, and where. What tools do we give those people to do their job?</p>

<p>One would think a proposed bill allowing access in the future to those deemed able and qualified to render help who were kept out this time would be a good thing. </p>
<p>I think a lot of the debate is about how the issue is framed and general distrust of anything government related.</p>

<p>2. Interesting question. A clever looter might load up whatever loot they could carry and call out to the approaching rescuers for help &#8211; thanking them profusely, of course, for carrying them to dry land.</p>

<p>Not sure what would be worth looting after a flood. If the looters wanted to take jewelry from flooded homes, they would have to dig out a lot of sludge and climb through a lot of mess to get the jewels. The TV and computer are toast anyway. Seems like it would be too much work for looters to make it worthwhile for them.</p>

<p>So you are saying that no-one should help each other out, we should wait helplessly until the government comes in a week later, and does its inept thing? Sorry you are drowning, I am sure a FEMA rep will come by in a few days and help you. I wouldn&#8217;t want to be a do-gooder and try to pull you out myself. Goodness. What lame logic. </p>
<p> I was in Cedar Rapids during their flooding in 2009. FEMA came in and caused a mess. The local Walmart did a better job of providing goods and services than FEMA did. I went on an organized volunteer effort, which started a mere 3 weeks later, and was amazed at the stupid things I was asked to do and the stupid things that were being supplied. Um 3 weeks later, and you still haven&#8217;t sourced a supply of diapers, from any of the major stores &#8211; all of which were not affected by the flood, please. And the &#8220;free&#8221; bottles of bleach, where it cost more to drive to the help center to get it, than the bleach was worth, etc, etc. </p>
<p>FEMA provided shelter&#8217;s with formaldehyde, and ended up with a problem, because they let homeless people from neighboring areas live in them, rather than actual victims, property owners, who somehow manged to find their own way to housing. It was a mess. </p>
<p>And interestingly the people that relied on government had their houses fallow for more than a year, where folks that proactively helped themselves were fixed up before 6 months. </p>
<p>Oh and then the city got involved &#8211; your business sign fell down, well you can&#8217;t replace it because the new city codes say &#8230;, and oh we want to be green so if you rebuild you must do this and this, and oh we need the federal government to redesign this area to be a nice park and oh we can&#8217;t can&#8217;t contractors come in from Missouri to do work cuz they are not licensed in Iowa &#8211; so unless you can do it yourself etc, etc. I think in 2016, the city is still trying to recover from the flood from their own city government stupidity. This is what the professional government help gets you.</p>

<p>I think you are mistaken. Most of the homes were not flooded to the rooftops. Many were only flooded to 2 or 3 feet. Many were two story homes.</p>

<p>2&#8242; of water and the furniture is toppled over and there is a large amount of silt everywhere. The plaster on the walls expands and falls off. </p>
<p>Seriously, you can&#8217;t just walk back in and everything is as it was as your cat greets you at the door.</p>

<p>You are wrong again, marque2. I lived in Louisiana for 25 years. I have experienced hurricane flooding.</p>
<p>You argued that nothing would be worth looting in a flood area. You are wrong. As I tried to explain, many homes in the flood area are two story homes. Many were not flooded the way you describe. </p>
<p>New Orleans was flooded after Katrina. Looting was widespread.</p>

<p>Actually we aren&#8217;t sure what happened in Katrina. The news media was so out make it look like a disaster zone, we had helicopters shot at, dozens of killings in the Superdome, people ransacking the hospital. Brian Williams was terrorized by gangs near his hotel, and nearly died from the rising waters, and it turned out to all be not true. Ho-hum.</p>
<p>As for the flooding of homes, whatever dude.</p>

<p>When the 35W bridge collapsed in Minneapolis, it was locals and passersby who first moved on to the rubble to assist survivors trapped in their vehicles to gain the safety of the river banks.</p>
<p>These same volunteers then guided the first responders to safe access from shore to the bridge rubble then assisted in passing rescue equipment from the shore to where it was most needed.</p>
<p>There was a young medical student (a passerby) who swam upstream of the rubble through the cloudy water to rescue the driver of a semi-submerged vehicle. The driver’s seat belt was jammed and this student had to return to the rubble for a knife to cut the driver loose. This student severely injured his foot on the submerged rubble during his brave and successful rescue.</p>
<p>The last commands heard from senior police officials ashore were to “get those f**king civilians off the bridge.”</p>

<p>The senior police officials were rude and crude but possibly correct about who should be doing what they were doing and where they were doing it.</p>

<p>Walt, No mob of civilians insisted on continuing to provide CPR after EMTs arrived.</p>
<p>Many people and their pets were carried to safety by their neighbors and others who had small boats, were familiar with the neighborhoods, could could operate in very shallow water, and were willing to risk their own safety to rescue others.</p>
<p>In some areas government agencies didn&#8217;t show up for days after people were stranded.</p>
<p>Individuals acted immediately to help their neighbors, when no official help was available, and they didn&#8217;t wait to get permission. It&#8217;s not clear why you are arguing against these praiseworthy actions.</p>

<p>Ron, I have no problem with volunteers until the properly trained people arrive and take charge regardless of how long that may be. Wasn&#8217;t I clear about that?</p>
<p>Our factory had a trained fire brigade and first responders to take care of some pretty dangerous and big fires and injured people until the local fire department or ambulances arrived and directed the scene. </p>
<p>Sometimes the fire-brigade was still used by the local fire department after they arrived and sometimes they were not. Disasters/emergencies such as fires and floods can be very chaotic, so like it or not, someone needs to be in charge (let hope they are qualified, trained, and make decisions as good as the information they have to make those decisions).</p>

<p>I can&#8217;t know the intent of Rep. Jonathan Perry, and I don&#8217;t think anyone commenting here can, either. But I do think we should at least consider what he says was his intent.</p>
<p>Perry says that he only got involved in this issue after a constituent complained that law enforcement officers were preventing volunteers from going into the flooded region to help. I believe him.</p>
<p>Perry also says that he has contacted law enforcement leaders to find out how to allow volunteers to get access to disaster areas in the future. I believe him.</p>
<p>Rep. Perry says that the licensing proposed by his legislation will enable volunteers to move through law enforcement roadblocks in the future. I have no reason to doubt what he is saying.</p>
<p>I think it is unfortunate that law enforcement feels it must control access to disaster areas. Given the widespread looting which has accompanied some disasters (such as Katrina), I understand the position of law enforcement.</p>
<p>I like to believe I am an open-minded libertarian, though not an anarchist. I probably trust law enforcement more than most who comment here.</p>
<p>I doubt that my comment will be very popular with my fellow libertarians.</p>

<p>Thanks to John Dewey for some much needed additional information and some much needed additional common sense. </p>
<p>The idea that Senator Perry thought that somehow standing in opposition to the immensely popular Cajun Navy would enhance his personal political power never did pass the smell test. </p>
<p>When the antagonist in the piece looks like a cartoon villain there is always a good chance you are not getting the whole story. </p>
<p>So then, the Huffington Post found in this story a Republican to go after and CD found rounded up the usual suspects (politicians seeking more power) for its Hall of Shame of regulatory overreach.</p>
<p>I don&#8217;t normally call myself a libertarian although it&#8217;s not that unusual for me to think Libertarians have it right on many issues. Either way, your comment is popular with me John, not that that will necessarily help you with all the self described libertarians here.</p>

<p>It&#8217;s not just looters who need to be denied access to a disaster area. It&#8217;s also gawkers. If thousands of cars were allowed to travel through a disaster area, the flow of law enforcement and rescue vehicles would be impeded.</p>

<p>Well then, deny access to gawkers and leave people who are trying to help alone. Yeah, I know- how do tell them apart? Clearly, that would be too much to ask of anyone, so I guess you just tell disaster victims they&#8217;ll have to wait for government approved assistance.</p>

<p>I think there is a more fundamental issue at play here. It is rarely, if ever, possible to make up a general rule that can be applied in all cases without bad judgment producing bad results.</p>
<p>That&#8217;s why I cited the example above of how successfully the State of Vermont suspended its normal regulatory apparatus during the response to Hurricane Irene. I don&#8217;t mean to suggest that Vermont is always a model of good government in regulatory matters &#8211; just that they deserve a lot of credit for getting it right in the case of Hurricane Irene.</p>
<p>So then, the effect of the kind of regulations proposed by Senator Perry will have more to do with how it is enforced than how it is written. No law, or absence of a law, is ever a good substitute for common sense and good judgment.</p>

<p>You&#8217;re absolutely correct. Therefore, it might be better to not have a general rule that needs to be suspended in times of emergency, based on that same unreliable judgement.</p>
<p>Keeping everyone out of a disaster area requires the belief that people are more often bad than good. The belief that the damage from looting outweighs any possible good from lives and property saved by rescuers.</p>
<p>Well, that, and the belief that someone must be in charge because people are unable to manage their own affairs.</p>

<p>It&#8217;s not just looters that need to be kept out. Many, many people who attempt to enter disaster areas are just gawkers. And they just get in the way. I&#8217;ve talked to EMT and civil defense folks who tell me thos can be a big problem.</p>
<p>No one, especially Senator Perry, is arguing that the Cajun Navy did anything wrong. I&#8217;m certain that neither Senator Perry nor law enforcement officials want to prevent aid from getting to victims (Well, not sure about FEMA.) But there is need for control and coordination in time of war and in time of natural disaster. IMO, Senator Perry is trying to work out a compromise between ordinary civilians and law enforcement. I think he deserves praise.</p>

<p>I agree, but I&#8217;m not sure how regulating and licensing people would help.</p>
<p>Government agencies can&#8217;t enhance people&#8217;s ability to take action in an emergency, but can only limit it. Why do I need a license to help my neighbor reach safety when his house floods?</p>
<p>I can also imagine people who only wish to gawk or loot could easily get licenses to enter restricted areas during an emergency.</p>
<p>The liability question is interesting. If rescuers who get hurt entering restricted areas can hold public agencies liable, can those already in those restricted areas who suffer because rescuers were denied access sue those agencies also?</p>
<p>Actually the solution is simple. Many government entities are currently immune from liability resulting from their actions. They cannot be sued. Any law enforcement agency fearing legal action can ask for legislation providing them with immunity. Problem solved.</p>

<p>That was me being cynical and somewhat facetious in a response to Not Sure. If he read my comment, I believe he understood my meaning.</p>
<p>I apparently have a lower opinion of politicians than you do, and see them behaving no better or worse than anyone else, which means they are motivated mostly by self interest, which isn&#8217;t a bad thing, and in fact is part of our nature as human beings. It allows us to survive as individuals, and therefore as a species.</p>
<p>We often hear complaints about &#8220;greedy businessmen&#8221;, who after all, are only acting in their own self interest, but absent government collusion, they are constrained by natural market forces &#8211; primarily the need to serve and please others in order to advance their own self interest in the face of stiff competition for consumers&#8217; dollars.</p>
<p>In the world of government and politics there are very few such natural constraints on a person&#8217;s ambition. As Lord Acton wrote: &#8220;Power corrupts&#8221;. I believe that no matter how noble a person&#8217;s intentions are when they first run for political office, they are eventually corrupted by the game and the process and lose sight of the reason they started on that path, eventually being interested in only those things they can do and say publicly that can help them get reelected and maintain control of their empire. They are to be treated with skepticism and very limited trust. </p>
<p>What I see in this story is a politician who observes people voluntarily organizing and coming to the aid of others who were stranded by floodwater, doing an excellent job long before government agencies were even on the scene, and doing it all without government permission or control. </p>
<p>That can be very disturbing and even frightening to someone who relies on the myth that they have an important role to play because people can&#8217;t possibly manage their own affairs without someone from &#8220;the Government&#8221; being in charge. </p>
<p>State Sen Perry is recommending that those private citizens be folded into the state apparatus through training and licensing so that they can be controlled &#8211; something they obviously don&#8217;t need or want. He is reacting to some people going off the reservation on their own. Scary stuff.</p>
<p>In my response to Not Sure, I was imagining SS Perry being convinced that volunteer groups like the Cajun Navy were a serious threat to the existing political order, and therefore something to be dealt with through legislation.</p>
<p>When I wrote that I didn&#8217;t need to understand Louisiana law to know what action to take, I meant that in an emergency, if I saw someone drowning, I wouldn&#8217;t need to know whether I was allowed to swim in that particular body of water before jumping in to save them, nor would I call an attorney for enlightenment on my possible liability in the matter. I suspect members of the Cajun Navy had similar priorities.</p>

<p>An understanding of Louisiana law doesn&#8217;t give legislators any special insight into the proper courses of action to take in an emergency.</p>
<p>If State senator Perry&#8217;s proposed legislation will exempt law enforcement agencies from liability, then they need not be concerned with who enters a disaster zone, or those in the area who are harmed because help was denied to them by restrictions on access. They are blameless in either case.</p>
<p>Actually, I find such a proposal to limit liability of government agencies to be even more disturbing than the proposals to train and license volunteers. How many more government employees can we allow to act with impunity and place themselves above the law?</p>

<p>Senator Perry referred to the liability issue in his statement. IMO, that&#8217;s a very important reason for this legislation.</p>
<p>Once law enforcement is onsite at the disaster area, they have a responsibility for ensuring the safety of civilians. Suppose a state trooper allows a Cajun Navy person to enter an area he knows to be unsafe. If the Cajun Navy person subsequently drowns, is the state facing a liability risk? According to Senator Perry, that&#8217;s exactly what law enforcement leaders told him. And that&#8217;s the major reason for this proposed legislation, according to the senator.</p>
<p>If the senator&#8217;s legislation removes the liability risk to the state, and allows law enforcement to give passage to the Cajun Navy, how is that a bad thing?</p>

<p>Senator Perry appears to be attempting to solve a problem brought to his attention by other people. That is what he is elected to do.</p>
<p>Anyone who has a conflict with what Senator Perry stated needs to determine if their conflict is with how Senator Perry identified and defined the problem or with his proposed solution to that problem.</p>

<p>State Senator Perry talks about the liability faced by the state. I think this is a big deal, and probably the major reason for his proposed legislation.</p>
<p>Once law enforcement and civil defense organizations are onsite at the disaster area, they apparently responsible for the safety of civilians. Suppose a state trooper allows a Cajun Navy sailor to enter an unsafe area, and that sailor subsequently drowns. It is certainly possible that the law enforcement officer and the state will be sued by the family of the drowned sailor.</p>
<p>As I understand it, State Senator Perry&#8217;s proposed legislation is needed in order to remove that risk to the officer and to the state. I do not understand Louisiana law, but I&#8217;m sure the senator and his staff do.</p>
<p>If the senator&#8217;s legislation removes the risk which caused law enforcement leaders to block the Cajun Navy, how is that a bad thing?</p>

<p>I&#8217;m not a lawyer, Not Sure, so I can&#8217;t andwer that myself. But I&#8217;ll bet that the law enforcement leaders in Louisiana know a hell of a lot more about Louisiana law than do you or I. And it doesn&#8217;t appear that they were worried at all about such a scenario.</p>

<p>No doubt. But this is exactly the issue at hand, isn&#8217;t it? The Cajun Navy is interested in helping people and the government is concerned with what the law says.</p>

<p>Once again, not sure, the intent of Senator John Perry was to get the Cajun Navy through the objections/roadblocks set up by law enforcement. He made that clear in statements and video provided to the media. </p>
<p>As I see it, the state senator is using the law to enable those who wish to provide assistance but were prevented from doing so. I think that is a proper job for a lawmaker.</p>
<p>Mark Perry calls State Senator a &#8220;pesky, busy-body, nanny state lesgislator&#8221;. I disagree, as I see no reason to disbelieve what Jonathan Perry has given as explanation. </p>
<p>I do not often disagree with Professor Perry.</p>

<p>Laws are passed and rules are enacted to solve problems. Although, truthfully, they may unintentionally cause more problems than they solve. </p>
<p>Continuous improvement in any process requires continual problem solving actions to address both old and new problems. </p>
<p>It&#8217;s difficult to make things perfect to those who only see perfection and things in black-and-white as desirable outcomes, but things can be improved if you find people willing to work at it and not give up too easily.</p>

<p>Yes, progress in proactive problem-solving is often two steps forward and one step backward and a continual process. Some things are not easy, predictable, or permanent. </p>
<p>I think you will find, if you ask your elected representatives, most of the stuff he or she works on is due to what the voters ask to be done.</p>

<p>One more important legal consideration which may have made State Senator Perry&#8217;s legislation necessary. 49 states in this country operate under the English Common Law ststem. As I understand it, the principle of Good Samaritan Law applies to those states.</p>
<p>Louisiana law, like the Canadian province of Quebec, is based on Napoleanic law. Based on what I have read, I believe that volunteers acting in a rescue capacity have a duty to rescue. That principle puts volunteers at far greater risk of liability than would exist in the other 49 states.</p>
<p>The point I&#8217;m trying to make is that because Louisiana operates under a different legal system, it is possible that legislation of volunteers may be more important than in other states.</p>
<p>I am certainly not an expert on Louisiana law. But I doubt that anyone else commenting here is, either.</p>

<p>1. They might be looters.<br />
2. They might not have proper training.<br />
3. They might get in the way of government workers.<br />

<p>What you missed &#8211; and almost everyone else missed &#8211; is that State Senator Jonathan Perry was helping the Cajun Navy.</p>
<p>It was law enforcement &#8211; doing their job under existing law &#8211; that did block some of the Cajun Navy. It was Senator Perry who devised laws to work around their roadblocks.</p>
<p>You folks may believe that laws governing civil defense procedures are unnecessary. Regardless, such laws already exist and may need to be altered.</p>
<p>I greatly respect Professor Perry&#8217;s opinions. But I think he was wrong to call Senator Perry a &#8220;pesky, busy-body, nanny-state politician&#8221;.</p>

<p>And that&#8217;s perfectly understandable, because he&#8217;s a politician. His primary objective at all times will be to further his own self interest, so any proposal that doesn&#8217;t immediately expose that interest may cause uncertainty and confusion.</p>

<p>I caught the intent of removing roadblocks for the Cajun Navy helping next time the first read-through. Maybe what we get out of a story about government action/inaction depends on how legitimate we view the legislative process before we read the story?</p>

<p>It seemed to me that Senator Perry was trying to help the Cajun Navy as well as help law enforcement. Where I believe he totally failed is in not getting the Cajun Navy on board before announcing his proposal. He probably could not have persuaded all the volunteers. But he could have shown them he wanted their input in meeting the needs of all parties.</p>
<p>I am bothered by the lack of respect being shown to law enforcement in some comments on this blog. I have relatives and friends who serve/have served in various Louisiana law enforcement agencies. They have a very tough job, and do it well.</p>

<p>I don&#8217;t carry the inherent disdain many people, including some here, seem to have with politicians, police, teachers, and others who are elected, appointed, or hired to represent and serve other people. Most, I believe, are doing the best job they can do with the resources and support they are given to do their job. </p>
<p>Whether Senator Perry asked for the Cajun Navy&#8217;s input is not clear. They or their supporters may have been the ones who contacted him about the liability and access problems he was investigating to ameliorate with his legislation.</p>

<p>I&#8217;m sure the job is tough, but they signed on to do it, didn&#8217;t they? And they get paid for that (as opposed to the Cajun Navy), don&#8217;t they?</p>
<p>I&#8217;m bothered by the fact a state senator has to get involved in the first place. Earlier, you said:</p>

<p>Not Sure, why would you be bothered by a state senator who got involved in a problem most likely brought to him by the voters he represents? That&#8217;s his job. </p>
<p>Most elected people have enough problems brought to them that they don&#8217;t have to go out and look for problems.</p>

<p>When you watch some of the YouTube rescue videos, you quickly find out how smart and tough and resourceful these good ol&#8217; boys and gals really are.</p>
<p>Training? They have been learning riverine operations since they were two years old.</p>
<p>The Cajun Navy represents what is grand about the USA. </p>
<p>This unofficial navy should be awarded an honorary presidential unit citation.</p>
<p>Senator Perry&#8211;yet another stinking lawyer&#8211;officially represents the cancer from within.</p>
